Robert B. Lower

Attorney

Mr. Lower is Counsel to FSF LLP. He has extensive high-stakes litigation experience in a wide range of disputes in both state and federal courts including class actions, patents, trademarks, trade secrets, environmental, employment, product liability, and complex commercial litigation. He is also frequently retained to counsel new and established businesses regarding strategies for obtaining and enforcing intellectual property rights while limiting liability. He frequently works with start-ups to negotiate outside capital funding and related IP agreements.

Mr. Lower currently acts as lead counsel in a class action lawsuit alleging systemic constitutional and civil rights deprivations against municipal defendants, and represents a NJ corporation in multi-billion dollar environmental action. He formerly led the negotiations before an EPA-appointed ADR team, developing technical arguments to obtain >90% reduction in preliminary environmental liability assessments for a large corporation. He formerly served on a joint defense group litigation strategy committees in multi-PRP Superfund matters and negotiations with the Environmental Protection Agency and the Department of Justice.

Mr. Lower also has secured favorable settlements for products liability defendants in New York and New Jersey; represented numerous corporations and individuals in employment, real estate, and commercial litigation; represented a global conglomerate in trade secret misappropriation litigation, including initial investigation, discovery, and settlement; and drafted and prosecuted non-provisional patents and patent applications for emerging technologies, cited in dozens of subsequent USPTO filings and patent applications by entities including General Electric, Cornell University, and Lockheed Martin.

Mr. Lower is licensed to practice in New York, at the United States Patent and Trademark Office, the Southern District of New York, and the Second Circuit Court of Appeals. He received his B.S. in Engineering at Clarkson University, and his J.D. from Washington & Lee University School of Law.
